Abstract: In accordance with the authority in DoD Directive 5124.02 (Reference (a)), this Instruction: a. Establishes policy, assigns responsibilities, and prescribes procedures for determining the appropriate mix of manpower (military and DoD civilian) and private sector support. b. Implements policy established in DoD Directive 1100.4 (Reference (b). c. Incorporates and cancels DoD Instruction 3020.37 (Reference (c)). d. Provides manpower mix criteria and guidance for risk assessments to be used to identify and justify activities that are inherently governmental (IG); commercial (exempt from private sector performance); and commercial ( subject to private sector performance). e. Reconciles and consolidates the definitions and examples of IG from section 306 of title 5, United States Code ( U.S.C.) (Reference (d)); sections 501 (note), 1115, and 1116 of title 31, U.S.C. (Reference (e)); Attachment A of Office of Management and Budget (OMB) Circular A-76 (Reference (f)); and Subparts 2 and 7.503(c) of the Federal Acquisition Regulation (Reference (g)) into a set of criteria for Defense-wide use. f. Implements aspects of sections 113, 118(b), 129a, and 2463 of title 10, U.S.C. (Reference (h)). g. Reissues and cancels DoD Instruction 1100.22 (Reference (i)).
